Frank Lay, Robert Freeman, and Michelle Winkler Need Your Help, in Pensacola, on September 17th, 2009!

These God-Fearing Americans are under attack for exercising their First Amendment rights, in the State of Florida. What did they do? They prayed to God!  ...and now some of them may face jail time!

"My faith is who I am. I am a Christian. I am a believer. I am not ashamed of the faith."             - Principal Frank Lay

Will you rise up now to help your Christian brothers and sisters? Or will you just go about your life, and pretend these injustices are not happening, until they are happening to you? History shows us that if we abandon those in need now, the wolves will continue to devour until they get to you!

"First they came for the Communists, and I didn't speak up, because I wasn't a Communist.
Then they came for the trade unionists, and I didn't speak up because I wasn't a trade unionist.
Then they came for the Jews, and I didn't speak up, because I wasn't a Jew.
Then they came for me, and by that time there was no one left to speak up for me."  - Martin Niemoller , German Pastor 1937,  Arrested on the order of Adolf Hitler and confined in  Sachsenhausen and Dachau concentration camps

It is inconceivable that in the United States, in a country that was founded as a Christian nation, a nation founded on the Gospel of Jesus Christ; that this terrible injustice can happen! We can read the Constitution, why can't the federal judges?

Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

America was founded by men and women who came here to freely worship the God of the Bible. Our Founding Fathers bled and died to secure this God - Given right for us! Our Founders said what they meant, and wrote their God-Inspired thoughts down on paper, in the Declaration of Independence and in the U.S. Constitution. They started their days in prayer to the Almighty, and established schools and colleges so our children could learn the Gospel of Jesus Christ and read God's inspired words in the Holy Bible.

As in almost all the state constitutions, the Delaware constitution of 1776 established a Christian State by requiring:

"Art. 22. Every person who shall be chosen a member of either house, or appointed to any office or place of trust . . . shall . . . make and subscribe the following declaration, to wit: "I ________, do profess faith in God the Father, and in Jesus Christ His only Son, and in the Holy Ghost, one God, Blessed for evermore; and I do acknowledge the holy scripture of the Old and New Testaments to be given by divine inspiration."

The people of this nation have lost touch with the ideals of America's Founding Fathers! In order to ensure civil government would foster Christianity and not atheism, it was prohibited for any but Christians to hold political office in many states! If you want to create and maintain a Christian society, requirements like the previous make good sense.

"Providence has given to our people the choice of their rulers, and it is the duty as well as the privilege and interest of our Christian nation to select and prefer Christians for their rulers." - John Jay, First Chief Justice of the U.S. Supreme Court

This sentient was also shared by the second President of the United States:

"Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other." - President John Adams

Today, we have many ungodly people in government and in our courts, and they are intentionally undermining the very foundations of this great Republic. This was NOT our Founding Father's intention. Read the words of President Lincoln, as he  observed this decay, and spoke to the American People of a solution, and of a course of action:

"The people are the masters of both Congress and courts, not to overthrow the Constitution, but to overthrow the men who pervert it!"  - Abraham Lincoln

Our biggest problem is not the enemy, they have always been among us. It is that there are too many Christians being "spectators" in America, instead of "participants".  How can those who profess to be in the body of Christ, allow evil men and evil women to repeatedly attack and bleed their fellow brothers and sisters, without taking action?

It is not enough for "Christians" to merely go to church, and pray; but never take the necessary action, and follow through when they get up from their knees! Some Christians go about their lives as if nothing is happening, perceiving each attack on someone else's civil or religious liberties, as just another minor cut that will heal in time. Thank God, our Founding Fathers did more than just "pray", when the British threatened to abolish their sacred liberties granted to them by the Almighty!

"Death by a thousand cuts", is an old truth that speaks to what is happening to our country today. America, and her people are needlessly bleeding because Christian men and women have neglected their family, they have refused to get involved, and stop an enemy they outnumber 10 to 1! Left unchecked, the cuts will accumulate until our country DIES!

"Though I speak with tongues of men and of angels, and have not charity, I am become as sounding brass, or a tinkling cymbal. And though  I have the gift of prophecy, and understand all mysteries, and all knowledge; and though I have all faith, so that I could remove mountains, and have not charity, I am nothing." (1 Corinthians 13: 1-2)

Many Christians today are not making public noise about what is going on in our country. There is even less action! In church after church, abandonment theology isolates congregations inside little buildings while they enjoy a false sense of security. Termites and rust continue to eat at the very structure of their perfect worlds, and yet they cannot see the imminent collapse of their society without their immediate and collective action!

"Thou believest that there is one God; thou doest well: the devils also believe, and tremble. But wilt thou know, O vain man, that faith without works is dead?" (James 2:19-20)

There was a time when most Americans understood, "United We Stand, Divided We Fall". They were not ashamed to sing songs like the "Battle Hymn of the Republic" and "Onward Christians Soldiers", and mean each word with every ounce of their being!

"For by one Spirit are we all baptized into one body, whether we be Jews or Gentiles, whether we be bond or free; and have been all made to drink into one Spirit. For the body is not one member, but many. That there should be no schism in the body; but that the members should have the same care one for another. And whether one member suffer, all the members suffer with it; or one member be honoured, all the members rejoice with it. Now ye are the body of Christ, and members in particular." (1 Corinthians 12: 13-14; 25-27)

The Federal Courts and the American Civil Liberties Union Attack School Prayer:

On August 27, 2008 a complaint was filed in U S Federal District Court against the Santa Rosa County School Board, School Superintendent and Frank Lay, Principal of Pace High School (the Defendants) .  The complaint alleged the rights of two minors had been violated in that the School Board, School Superintendent and Frank Lay were forcing their religious beliefs on the minors.

On December 15, 2008, the Santa Rosa County School Board (Defendants) admitted liability to the charges. This was a grave injustice to the citizens, done without their consent!

On January 9, 2009, the Court issued a Preliminary Injunction that ordered the Defendants to discontinue their policies, practices and customs of advancing religion.

On January 19, 2009, all school board employees were notified via a memo from the school board attorney of the court order.

On January 28, 2009, Frank Lay asked Robert Freeman to offer a blessing of the food at a dedication of a new field house at Pace High School.

On February 4, 2009, Frank Lay and Robert Freeman submitted to Superintendent Wyrosdick their account of what happened at the field house dedication.

On February 5, 2009, Mr. Wyrosdick notified Frank and Robert via a written memorandum that "your actions were not appropriate and this type of action should not take place again." Mr. Wyrosdick went on to say in the memorandum, "Let me take this opportunity to thank you for your honesty and character in which you assisted in describing the incident.  As well, let me thank you for your leadership at Pace High School".

On February 20, 2009, Mrs. Michelle Winkler, a school board employee, attended the Employee of the Year Banquet. She has been accused of violating the Court Order by asking that her husband say a prayer at the banquet.

On May 5, 2009, the plaintiffs (ACLU) files a motion for an order to show cause why Mrs. Winkler should not be held in violation of the temporary injunction.  In that order the plaintiffs made reference to a "possible" violation by Frank Lay and Robert Freeman. They did not seek an order to show cause regarding their (Frank and Robert) conduct.

On May 6, 2009, Judge Rodgers issued a Permanent Consent and Decree Order.

On July 1, 2009, the Christian Educators Association International (CEAI) filed a Motion to Intervene in the case.  They wish to intervene in the case to represent the interest of school board employees with respect to the Consent and Decree Order. The CEAI contends the Consent and Decree Order that was agreed to by the School Board and the ACLU goes beyond law and previous court cases thus infringing on the Constitutional rights of the employees.

On July 20, 2009, Judge Rodgers issued a Notice and Order of Criminal Contempt Proceedings. This order requested the U. S. Attorney prosecute the case. Trial date is set for September 17, 2009, 9:00 a.m. in Courtroom 4 North, One North Palafox Street, Pensacola.

On August 3, 2009, the Christian Educators Association International (CEAI) filed a Reply Motion to Intervene.

On September 4, 2009, Liberty Counsel's Motion To Intervene will be heard by U S Federal Judge Casey Rogers, at 8:30 a.m. at the Federal Courthouse in downtown Pensacola.  As you may know, this is a request on behalf of the Christian Educators Association International (CEAI).  CEAI is asking permission to take part in the proceedings to have their interest protected.  They allege the rights
of Christian educators have been infringed upon by the Consent Decree agreed to between the Santa Rosa County School Board and the ACLU. The courtroom proceedings are open to the public.  The courtroom gallery will accommodate approximately 60 people.

September 17, 2009, Court Date for Frank Lay and Robert Freeman. We have been in discussions with the City of Pensacola in regards to assembling downtown on Sept 17 for the trial.  The police department and the city manager's office have told us we do not need any permits.  They said we have the Constitutional right of assembly.  They will require that no traffic be impeded and all streets remain clear.

We can gather across the street from the federal courthouse and on the sidewalks. The U S Marshall's office informs us that no one will be allowed to stand on the courthouse steps or inside the courthouse.  Please encourage anyone and everyone you know to come to downtown Pensacola to show support for Frank and Robert!!  It would be wonderful to have several thousand God-Fearing Citizens show up.  If Michelle Winkler's trial is any indication, this could be an all day event.

People attending may want to think about bringing folding chairs, cold drinks and something to eat. For those of you that may not be aware, parking in downtown Pensacola is somewhat limited.  You will need to bring some change as the parking meters only use quarters.

How can you help?

1. Spread the word!  You may think your friends know what is going on but they may not have a clue!  Please tell everyone you know. Use your mouth, your phone, your email - any way you can. There is strength in numbers.

2.  If you can possibly help financially, you can contribute at ANY First National Bank of Florida including the one at the Pace Walmart.

The account is the Lay and Freeman Defense Fund. When this first began, Liberty Counsel was giving free legal assistance, but now that the charges have now been changed to criminal charges, Mr. Lay and Mr. Freeman have had to secure a criminal attorney. We have already been able to help with the $8,000 retainer fee for Mr. Lay and Mr. Freeman's attorney.  Now we are saving for additional legal expenses that will be required for Mr. Lay, Mr. Freeman and Mrs. Winkler.  If you are out of town, you can send donations to:
